1. Acceptance of Terms

By downloading, installing, or using StackPilot ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and 802.Software ("we," "us," or "our") regarding your use of StackPilot.

2. Description of Service

StackPilot is a mobile application that provides management and monitoring tools for Heroku applications. The App allows you to:

• Monitor your Heroku applications in real-time
• View application logs and metrics
• Manage dyno formations and scaling
• Receive push notifications for application events
• Access Heroku API functionality through a mobile interface

The App operates by connecting to Heroku's public API using your Heroku credentials. We do not provide Heroku hosting services or modify Heroku's functionality.

3. User Accounts and Credentials

3.1 Heroku Account Requirement

To use StackPilot, you must have a valid Heroku account. You are responsible for:

• Maintaining the security of your Heroku credentials
• All activities that occur under your Heroku account
• Complying with Heroku's Terms of Service
• Ensuring you have the right to access and manage the Heroku applications you connect to StackPilot

You are solely responsible for any actions taken through StackPilot using your Heroku credentials. We are not liable for any unauthorized access to your Heroku account.

4. Acceptable Use

You agree to use StackPilot only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the App in any way that violates applicable laws or regulations
• Use the App to transmit malicious code or engage in harmful activities
• Attempt to reverse engineer, decompile, or disassemble the App
• Use the App to access Heroku accounts you do not have permission to access
• Interfere with or disrupt the App or servers connected to the App
• Use the App in a manner that could damage, disable, or impair the App
• Attempt to gain unauthorized access to any portion of the App

5. Intellectual Property

The App and its original content, features, and functionality are owned by 802.Software and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

"Heroku" is a trademark of Salesforce.com, Inc. We use this trademark solely to indicate compatibility with the Heroku platform. Our use of this trademark does not imply any affiliation with or endorsement by Salesforce or Heroku.

6. Disclaimer of Warranties

You use the App at your own risk. We are not responsible for any damage to your Heroku applications, data loss, or other consequences resulting from your use of the App.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, 802.SOFTWARE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

This includes but is not limited to damages resulting from:

• Your use or inability to use the App
• Unauthorized access to your Heroku account
• Any actions taken through the App affecting your Heroku applications
• Errors, mistakes, or inaccuracies in the App
• Interruption or cessation of the App

8. Indemnification

You agree to indemnify, defend, and hold harmless 802.Software and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Your violation of Heroku's Terms of Service

9. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms in the App and updating the "Last Updated" date.

Your continued use of the App after any changes to these Terms constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the App.

10. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms.

You may terminate your use of the App at any time by deleting the App from your device and removing your Heroku API key.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which 802.Software operates, without regard to its conflict of law provisions.
